When it's not restarting, how much time passes between shutdown and attempted start?
I would lean towards the battery also. If you give a "dead" battery enough time between heavy loads, it can gather the energy for a start. Hence, when you get to work and don't start it for 8+ hours, it "rests" enough to start the bike again. When a battery is failing, it can usually push enough power to keep running but can't draw deep enough to push the power needed to start a vehicle. I just went through the same thing with my Jeep. In fact, at startup, the battery pushed everything it had to the starter and my radio would lose all it's settings (time, radio presets, eq presets, etc). New battery, no issues.
Try borrowing a friend's good battery and see if it does the same thing.
