Isn't this against his rights in the USA?
I would think that being held without being charged would be a violation of his rights...

Not at all. It depends on the state, but the D.A. always has a day or two to charge or file for an extension.

Besides that, if you go to jail after 5pm on friday, you get a free weekend in jail. No fuss no muss.
