Own Burned CDs, get searched

Here is a link to a real court case out in Viriginia where a guy got stopped by a cop for an "equipment failure", but then had his car searched because the cop saw CD-Rs in the car, and they had been trained by the recording industry that those indicated he was a music pirate.

He ended up going to jail because they found pot in the car, but only after searching for more "pirated CDs". One more chunk of the 4th ammendment being stripped away...

Some officers use that as probable cause, to effect a search.

It's the "plain view rule", it's common knowledge, and shame on them for not thinking about it. You know they found some dope in the car, and though the media didn't report it, there's a strong chance the driver was stoned. What do stoned drivers do? Run over ****, and laugh. We, as motorcyclists should see this as a good thing that's one less idiot on the road we have to worry about.

That's what saved him. Though most people don't want to look at cops wives (cops girlfiends are another story), that would have been a legitimate use of those Cd's.

The courts ruled correctly in this case, I just don't like it that a dumbass goes about his dumbass ways.

Oh well, in the business you learn you can't win them all, and give a person enough rope....

It doesn't say how many CDs were seen, just "several". What if they saw 50-100 CDs, each with the same poorly created labels; ie, 50 Michael Bolton CDs? That would trigger a search in my book.

This could just be poorly worded.

How did said police officer know that they were pirated cds? Is it illegal to make copies of cds that you already own? Is it illegal to make a mix cd from a collection of cds that you already own? Were the cd's in question labeled "pireted music" or possibly "stolen musical entertainment"?
