A Korean woman from Gwinnett County has filed a $5 million lawsuit against the Department of Homeland Security after a citizenship officer pleaded guilty to sexually assaulting her during a citizenship interview.
Sang Yi Sevilla says Officer Kelvin Renard Owens intimidated her in June 2004 by asking, "If I let you pass, what are you going to give me?" according to a suit she filed Friday in federal court in Atlanta.
Owens grabbed her breasts and asked her to meet him outside the building at 4 p.m. to find out whether she had passed the test, the claim says. Sevilla says the officer also grabbed her hands and put them on his genitals and put his hand between her legs. She says she pushed him away and contacted authorities. Owens, of Jonesboro, pleaded guilty in federal court to sexual assault in March 2005, the U.S. Attorney's Office said. A judge ordered him to spend weekends in federal prison for six months. The judge also put Owens on probation for five years and fined him $2,500.
U.S. Attorney David Nahmias said in a statement when Owens pleaded guilty that his office takes misconduct allegations seriously.
"This case represents reprehensible conduct by a federal employee," he said then. "The victim in this case not only was making every effort to legally seek her citizenship in this country, but was brave enough to fend off an attack from one of the people she needed to help her gain her rightful citizenship."
A lawyer for the U.S. Citizenship and Immigration Service denied any liability in an April 2006 letter to Sevilla's lawyer, saying Owens was not acting within the course or scope of his employment at the time.
Sevilla is still waiting to hear if she passed the U.S. citizenship test. Staff writer Brian Feagans contributed to this story. |

WTF is with this guys punishment? Weekends in prison? "Here, we'll let you continue with your life and pay your dues when its convinent to you." ?!?! This is more than likely not the first time this jackass did something like that! This punishment is definately not fitting for his crime!! He should have gotten the book thrown at him for abusing his power! |

| Re: Sex assault victim sues Homeland Security for $5M Well the dumbass shouldn't have confessed in the first place. No witnesses, no evidence. But as we know in these cases the MAN IS ALWAYS GUILTY CAUSE THE WOMAN SAYS SO. Even if he didn't do it he was guilty.
But, lets say he is. I see your point. Law breakers of any kind shouldn't receive breaks. But, I have also witnessed this with my former step-daughter's crackheaded boyfriend. He was put on a bracelet cause the courts didn't consider him a bad enough criminal to put in jail and with the over crowding as it is, it was cheaper and easier to pu him on the bracelet. This way his family had to take care of him, vice the taxpayer. Still though, If the skinny runt was in prison gettin' his ass pumped by bubba and his friends 3 times a week, maybe his attitude would changed.
Probably the case here. |

"Lets say he is." ? He confessed... He did it.
For some reason this guy was persuaded to admit it, maybe they did have more evidence than they're releasing, or maybe the guy felt guilty, or maybe he was just an idiot. Your first paragraph sounds like the EXACT OPPOSITE of the "always guilty" problem, it almost sounds as if you don't want this guy prosecuted...??
This type of sexual assualt is unforgiveable and should be harshly punished! |

What I am saying is, never admit to anything. Let them prove it.
But, you are right in a sense that they may have had more than they are releasing. Who knows, maybe they are secretly taping him or, it was a sting operation to catch this guy cause there were complaints in the past on him. Definitely more to the story than they are telling.
I am just tired of men getting accused of sexual harrassment or harrassment in general. This has gotten out of hand and people are using this as an excuse for everything. No different then the PMS rage that happened back in the 80's that basically allowed women in the US to get away with everything cause all of the sudden they had PMS.  Or our kids coming home from school going, "you can't spank me anymore cause that is child abuse and I can call the cops on you". Know what mine got? Swat on the ass and I handed them the phone. Then I told them, "Call. When you are in your 4th foster home don't call me". Ended that crap right there. Probably the only time I went to a PTA meeting was to tell the school board and the teachers to get CHILD ABUSE right and stop telling the children this BULLSHIT. Everything gets blown out of proportion in this country.
But to this guy. If his is guilty he and bubba should get aquainted. Then of course he could sue the state and prison board for putting him in a cell with bubba the rump ranger. |

Been around for awhile. Basically they plead hardship of some type and the judge makes them spend time in prison on the weekends. Had one guy while I was in the Navy do this. He was released during the day to come work with us and then at night someone had to take him back to county and he stayed there on the weekends too.
I agree. Most likely a plea bargin to keep from being passed around while on laundry detail. |
