| Re: Procycle Columbia Mo BAD GUYS! STAY AWAY! I did buy from them in march. While my deal wasn't without it's own headaches and surprises I walked away satisfied with the price and the knowledge that I will probably not use them again. I posted about the experience here somewhere. |

They have no record that my bike has an extended warranty!! They (Yamaha) called Procycle, then called me back to inform me that the bike has a warranty, but through Western (who is that?) and not a Y.E.S. Factory Warranty. I stated that the paperwork was all on Yamaha Y.E.S. stuff and that's what I thought I was buying. I also told the guy at Yamaha that I think Procycle is shady and I do not want to do any business with them or deal with them at all.
I just faxed over all of my paperwork and information on the bike to Yamaha. Just have to see where it goes from here. I could see some sort of class action law suit being formed against them. I doubt that M and I are the only people that they have pulled this scam on. I just don't know how something like that gets started.

Discount deals at a local motorcycle and ATV dealer might not be as good as advertised, according to a consumer protection lawsuit filed this morning by Missouri Attorney General Jay Nixon. ProCycle, 2600 Range Line St., is accused of luring customers through misleading advertising and then charging a higher price by adding processing fees, credit card surcharges, delivery fees and other hidden costs.
The company is owned by Shernaman Enterprises Inc. of Missouri. Owners of the company did not return a phone call seeking comment this morning. "This is your classic bait-and-switch scheme," Nixon said in a news release. "ProCycle is bringing customers in the door by advertising one price, reassuring them of that price, then hitting them with hundreds of dollars in extra fees. Misleading consumers that way is not allowed under Missouri law." Customers were told by ProCycle employees that he price tag attached to an all-terrain vehicle plus a $65 processing charge was the final "out-the-door price," when, in fact, ProCycle charged or tried to charge other fees, according to documents filed in the case.
In one example, a customer paid $4,000 for an ATV advertised for sale at $3,500, about 14 percent more, because of additional fees, said Travis Ford, spokesman for the attorney general's office. Nixon's lawsuit also alleges that ProCycle ran radio ads saying there were no hidden fees on advertised deals. The attorney general's office said at least 25 customers have filed complaints against the Columbia dealership. Similar lawsuits also have been filed against the company's two locations in Springfield. Nixon's lawsuit seeks preliminary and permanent injunctions against the company. It also asks the court to order the company to fully reimburse consumers who bought merchandise for a higher price than advertised, pay a penalty of $1,000 for each violation of state law and reimburse Nixon's office for investigation and legal costs. ProCycle, founded in 1975, sells new and used motorcycles, ATVs, scooters and watercraft made by Honda, Yamaha and Suzuki at three locations in Missouri, according to information on the company's Web site.

A few years ago I went there looking for a bike. They had an '03 CR125 that was in pretty good shape and I don't remember what they wanted for it, but with what I was trading in, we came to an agreement of $1300. They gave us a piece of paper confirming the price, we signed it and everything. So anyway, they start the bike up and I can tell there is something wrong with it. The bike needed a new piston and rings and they said it would be a week or so before they could fix it. Now, that should have thrown up a red flag, but I was young and dumb and I wanted the bike so bad I didn't care.
At this time I was 15, so I was still in high school. My mom and her husband had planned to go pick the bike up one day while I was at school and have it waiting for me when I got home. They went to get the bike, got it loaded in the back of the truck and everything and went back to pay for it. Well, it seemed as if the fine folks at ProCycle had lost the paper we had signed for $1300 and that just wasn't enough money. I think they said they wanted $1500 and figured that they would pay for it. Well, my parents got pissed and told them to unload it and load my old bike up and they left.
I ended up getting an RM-Z 250 out of the deal, so it ended up being for the better, but I couldn't believe the way ProCycle handled that deal and I would never walk into their place again. I strongly recommend that no one ever go there, no matter how low of a price they "claim" on something. Be sure that the price on the bike or four wheeler is not the actual price. |

The deal went well and actually they treated me right. The out the door price was the same as advertised with no hidden charges. It seems I may be one of the lucky ones. |
