| i hit an 84 year old woman just got off work made a right onto the main road. at the very next intersection the woman doesnt see me and goes for it possibly running the stop sign i t bone her and slide a good 30 feet she gets a ticket i dont. do you have any advice for me? ive never had to deal with something like this. i went to the hospital afterwards to get checked out my neck isnt broken they just thought it was |

Her insurance is going to want to settle since (from the ticket) she's in the wrong. You have some leverage there, so don't be afraid to ask for more. It's normal for all your expenses (medical and don't forget lost wages) plus replacement of gear, etc, as well as covering bike repairs. You shouldn't be paying one cent out-of-pocket, and if you do, it should be reimbursed. You can get short-changed on gear as most policies only provide for replacement of mandatory safety gear.. Sadly, this mostly means just your helmet..
Anyway, if you're not happy with what gets offered, find a decent lawyer (one who has dealt with motorcycle claims before)..It'll get you even more, but you'll be paying for it. |

| Re: i hit an 84 year old woman you might get 5k.. but you should ask for much more than that.. i had a friend get rearended by a girl who said her brakes went out.. he was on an 04 zx6.. he ended up on an 07 zx10 after the insurance claim.. so make the insurance company pony up.. oh yeah... and he ended up with a KR tuned full system on that 10 |

| Re: i hit an 84 year old woman Wow glad your ok Rufino. Definantly go after replacment gear. Her insurance company should replace everything she damaged including your gear. It should be like the accident never happened, besides the new bike you'll have of course.  I agree with IDavis you'll probably get around 5k for the bike, plus the value of the gear, court and hospital fees. Don't settle for anything less it wasn't your fault and you shouldn't pay a dime.

| Re: i hit an 84 year old woman i got pretty screwed on my accident,my lawyer was only able to get be about 1k,i chose not to settle until he dropped me then i got the full 10k..my lawyer was saying "well his insurance only covers 10k and suing him out of pocket wouldn't do much"...blargh |
