The theory developing (and I agree with it) is that Yamaha built a motor capable of 17500RPM, marketed it, then realized how many engines would blow up at that speed. They then applied "The Formula" (ever watch Fight Club?) and determined that the class action suits and backlash would cost them less than the massive recall and replacement of tens of thousands of engines. So they fitted it with a pants on fire tachometer, released it to the public and now they're playing dumb, waiting for the **** to hit the fan.
What a ****ing disaster. At this point it doesn't matter how good the bike actually is, 17500RPM or not. This will end up in commerce school textbooks as an example of how not to launch a new product.
LTL: I'm thinking it might be more interesting for you to take delivery of the bike and get in on the class-action. I think Yamaha could end up having to pay a bunch of money out to owners. Remember the Mustang Cobra, and more recently the RX-8? |

The last firm my GF worked for was a class action firm. The relator gets paid a shitload of money.
But honestly, I don't want to get involved in all of that. I just want my money back.
Found the owner of this business and just read every one of their cases over the last 5 years. They always show up to small claims court without council. |

Ford calc'd the costs from suits brought by dead, burned people's families, figured that cost was less than fixing their shoddy gas tank design, and left it out there to kill people. Quote: |

All kidding aside, their biggest loss was me as a customer. They're out of their minds if they don't think they would have gotten a grand out of me through future business. I mentioned that to him too, and he didn't even respond.
And why lose me? It costs them absolutely nothing to give me my deposit back! |

Have any of the small claims cases that this company has been involved with pertain to their deposit contracts or their sales documents?
If so, how have they been decided?

A bunch of friends with picket signs in front of their building, informing the world at large of Yamaha's fraudulent claims and the dealership's complicity and theft. Makes for excellent TV and Newspaper coverage.
Every motorcycle forum in North America will know who this asshole is and what he's done so that AFTER he's been made the scapegoat and fired he'll be essentially unhireable within the industry.
**** small claims.. your lawyer is leaning toward a full blown jury case for false representations.. it would produce a better payoff on a contingency basis.
Have someone from the local media's "consumer fraud investigative team" (    ) make a few phone enquiries about this to help get them thinkin' right.
Bottom line - They produced nothing and the product which they were touting was sold on the basis of fraudulent claims. They're acting directly against the interest of their intended market segment, all of whom are wired into forums, and all of whom will know this. Yamaha's reputation will suffer because of the dealership's actions.
There's no way for them to win except to capitulate fully and immediately. |

The only time they did was when there was a large PI suit, last year, where Suzuki was also named. You remember my PM from about 6 months ago?
