I was ripped off!

Bought a motor from a guy off of e-bay (says it all). I didn't win the auction, but he said he would rather sell to me because he wouldn't have to ship, as long as i matched the high bid. Well, I took it out for a test ride today and came back doing the usual; tighten any loose bolts, adjust chaing, etc... I look down at the front sprocket cover and see very small drops of oil on it. Okay, WTF <--- I am thinking to myself. I look over and see there is a very small hairline crack in the block. Keep in mind this guy said the motor was mint only had 69 miles on it. I really zero in on the problem area and it almost is looking like there was a MF'n Hole (about size of a quarter) and they filled, sanded, and polished to look like new. Actually, it looks as if there used to be a hole in the case about the size or a quarter and it was filled with something. Anyhow, there are these very small pin holes (5 of them) right in the center of the patch work.

Now you can imagine how pissed I am right about now... I called the guy and left him a polite VM and also e-mailed him explaining what I found. The thing that gets me is that he bought it wrecked and rode it for a few days before he parted it out, so he would had to have known about it.

Now, the motor ran real strong, didn't seem like anything was wrong with it at all. Pulled hard out of the corners all the way to 10 grand, perfect radiator, nice solid clutch, and just everything seemed new...

Is this an easy fix, or is it always going to be a reoccuring problem with the oil build up around the damage? Ideally I would like to get my $$$ back, but I don't know how good my chances are.

Anyway, sorry for ranting, but I had to vent somewhere. Heres the auction: http://cgi.ebay.com/ebaymotors/ws/eB...tem=2487415668

Re: I was ripped off!

Motor sure looks Mint in the pictures. Do you have any pictures of the damage area? I buy a bunch of stuff of e-bay and this kind of thing is my worst nightmare. If you live near him you can confront him and atleast get some if not all your money back. Keep us posted.

You can faintly see it one of the pics on ebay. In person, you reall have to look for it.

I know where the guy lives, it took me 2.5 hours to get there from my house.

Ebay is buyer beware. Wrong of him to palm it off onto you, but he's under no obligation to inform you of any problems. ANyway, it doesnt look too bad. Take it to a professional and get their opinion. If it runs hard and seems fine you may have got yourself a bit of a bargin. Just get a professional opinion on what to do.

Poking the Devil with a stick then running away

Re: I was ripped off!

Not to be devils advocate here but:

"Bought a motor from a guy off of e-bay (says it all). I didn't win the auction, but he said he would rather sell to me because he wouldn't have to ship, as long as i matched the high bid."

isn't that against ebay policies? Im not saying it to be a dick, Im saying it because it's a common practice by scammers. Friend bids on high-dollar item, "winning bidder cant /wont..." and the offer is yours if you match their price.

I'd say unlikely there is much you can do via ebay but if he sold you a legit. engine and you have some documentation of such, you should have X amount of days to get your money back of you so chose. In many states there are laws concerning verbal contracts as well.

If it doesen't look fruitful, be creative

Best thing you can do now is act on something - don't let him not responding to you waive any chance you have at a refund if he decides to be tricky. 2.5hours ain't much, bring friends

Re: I was ripped off!

Take it to an Aluminum boat building shop..I've got some work done on motors by places such as that, for worse damage...or, JB weld it...

Re: I was ripped off!

from the looks of the pic you can have it welded. i would take it and have it checked out by a dealer (compression, etc). see if you can run the vin number and see what you come up with. maybe if you work in reverse you can come up with something that will help you out (if the motors stolen then use that to your advantage). but, for what you've spent on the motor i would do all the homework i could so you will feel good about the situation in the end.

That feedback wasn't posted before I bought this motor. I don't know what recourse I have. Going over to this guy's parents house with a bat is probably just going to land my ass in jail. I don't know what legal recourse that I have at this point. I mean, it was obviously FRAUD. Today, I will contact the Brevard County Sheriff and see what interest they have in this since it is involving more than $500, I believe it's a felony.

Re: I was ripped off!

If he doesn't give you the time of day I say ask the cops to escort you to his house and have a little chat with him in person. Like someone said before his parents might step in in a good way but if he is older and if they are just like him this will only get ugly which is why you would want the cops there so that no BS stories could get made up about you beating his ass or anything. I know its alot of $$ but its not worth the legal actions in the end

Good luck

Re: I was ripped off!

I don't know if this will help but I bought a 929 for $1500 from a guy because the motor had a crack on the oil pan, it didn't come with front plastics or anything like that. I tried JB weld just for kicks, 2500 miles later it's still running strong. I have really pushed the motor and so far no leaks, not to say it won't spring one later but for $1500 where could I go wrong. Try JB doesn't make up for being lied to but at least it won't leak. Its well worth the $5 you pay for a tube.

Re: I was ripped off!

I live in Tampa and he lives over in Melbourne, which is about an hour from orlando---just south of Cocoa beach, fl. I figure if he does the right thing, and tells me he didn't have any idea about the crack/hole and refunds me the money... Then I know it was an honest mistake. On the other hand, if he doesn't respond to my phone calls or e-mails, then I know he intentionally tried to cover it up and rip me off.
