Jan. 1, we can now wear our foamie plugs without getting ticketed!

For those of you that don't know, it is illegal in California for motorcyclists to use foam disposable earplugs. Yes, many have actually been ticketed for trying to protect their hearing.
See vc 27400 for current wording of the law which specifies custom earplugs only:
current DMV law

Thanks to Marc Danziger on the LABiker list and CA State Senator Debra Bowen this law will change effective Jan. 1st.

New language reads: (which deletes 'custom plugs':

SEC. 45. Section 27400 of the Vehicle Code is amended to read:
27400. A person operating a motor vehicle or bicycle may not wear a headset covering, or earplugs in, both ears. This prohibition does not apply to any of the following:
(a) A person operating authorized emergency vehicles, as defined in Section 165.
(b) A person engaged in the operation of either special
construction equipment or equipment for use in the maintenance of any highway.
© A person engaged in the operation of refuse collection
equipment who is wearing a safety headset or safety earplugs.
(d) A person wearing personal hearing protectors in the form of earplugs or molds that are specifically designed to attenuate injurious noise levels. The plugs or molds shall be designed in a manner so as to not inhibit the wearer's ability to hear a siren or horn from an emergency vehicle or a horn from another motor vehicle.
(e) A person using a prosthetic device that aids the hard of
hearing.

hmm, didn't know that, kinda stupid that was illegal in the first place, I think laws that pertain to bikes should only be written by people that ride

I like the idea, but this line is open to sooooo much interperation, I can easly see it taking mucho dinero and court cases to sort it out if push ever comes to shove. 'personal hearing protectors' can easly mean ones prescribed by a doctor, and what is 'injurious' nosise levels? How would you prove your helmet is lould enough to be injurious? Helmet mounted DB meters? Have the state spend a few Million $$$ testing every helmet in every condition and make an 'approved' list? Reguardless, I hope it is a step in the right direction. In the mean time I will continur to use foam earplugs, legal or illegal. But more likely, its just another stir in the pot of bureaucracy.
