A gun was pulled on me.

Saturday, as I was sitting at a traffic light, I noticed a van two lanes over stopped at the light. I noticed the driver was looking at me. I paid no attention to him. He then whistled at me and said "hay, do you have a cigarette?" I turn my head and in his right hand is a handgun. I shook my head and at that time, the light turned green and I took off.

I was stunned. I did not know what to do. I looked back and they turned the opposite direction. Now, just prior to this, I must have passed a half dozen officers. Now I could not find one in site. About a mile down the road I noticed a local police car driving towards me. I flickered my headlights and waived my hand trying to get their attention.

The officer pulled over. I told her what had happened and gave her a description of the vehicle, the occupants, and details of the event. She called dispatch and informed other officers in the area to be on the lookout for the vehicle.

Upon going over the event in retrospect, I think the gun was fake. It seemed way to shiny, but I do not know. A couple of punks riding around with a gun trying to get attention.

Re: A gun was pulled on me.

About 15 years ago when I was out riding my bicycle, some punks slowed down in a car, aimed a gun at me and fired it, producing some very loud noise, but apparently no bullets. Either a cap gun, or blanks, or something. I was not amused.

He was asking for a cigarette? Maybe it was one of those gun-shaped cig. lighters?

Re: A gun was pulled on me.

That's how people get shot and killed. Kids pointed guns, and I am sure many of you have heard of the countless times that kids have pointed fake guns at police, and the police have shot and killed the kid. Its not something to mess around with.

Team Honda - well sorta...

If it had happened to me, they'd be dead. Plain and simple...

is it the /fearing for your life/ that would justify shooting him? I'm just curious as to how the law is written about stuff like that..?

Yes, TN you must fear for the life of you or others, or fear imminent bodily harm. That said, If I see the business end of a gun my way, it's game over.

Pointing a firearm is a felony in NC. Any felony commited upon you authorizes lethal force. Your first requirement is an attempt to retreat, if that fails, lethal force is authorized.

Someone points a gun at me, fake or not, I'm taking them out.

Re: A gun was pulled on me.

Scary stuff man.

I was watching cops the other night and one guy got beat to hell in the face by a baseball bat. He brought out a rifle to ward the guys off while they destroyed his car and beat up his girl. The police repeatedly asked him if he "pointed" the gun at them. I suppose so that they would know whether to charge one of them with assault and the other with pointing the deadly weapon at him.
